The services offered on the www.elitediffusion.com website (hereinafter the “Site”) are provided by Elite Diffusion. In order to benefit from the services offered by Elite Diffusion, we ask you to carefully read these general terms and conditions of sale and use (hereinafter the “Terms and Conditions”). The order of services is reserved for users who have read these Terms and Conditions in their entirety prior to their order and have accepted them without reservation; any order implies full and complete acceptance of these Terms and Conditions.
Elite Diffusion reserves the right to modify these General Conditions at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations previously accepted by Elite Diffusion. It is therefore imperative that you consult and accept the General Conditions at the time you place your order, in particular in order to ensure you of the provisions applicable at the time of the order. These General Terms and Conditions are valid from January 1st 2020. This edition cancels and replaces all previous versions.
INTERNET ORDERS: Please note that all payment information is encrypted and secured by BNP PARIBAS. Our site will gradually evolve over time, and you’ll find all the products offered by Elite Diffusion: CDs, DVDs, SACDs and other media, Accessories, Cables, Furniture and the range of audio and digital audio electronics we distribute through distance selling, with a trial on request.
PHONE: For the sake of efficiency and quality of service, we recommend that you place your orders via the www.elitediffusion.com website. The speed of the process means same-day dispatch and avoids the need to order a temporarily unavailable item, as our site automatically updates its stocks. We accept payment by credit card, or we can await your payment by cheque or bank transfer. We also offer Paypal, and now ALMA, which enables you to pay for your orders in instalments. Our switchboard is open from 9.15am to 1.00pm and from 2.00pm to 6.15pm from Monday to Thursday, and until 5.15pm on Fridays on 01 34 50 22 22.
MAIL: For all mail orders, it is preferable to contact us by telephone to ensure the availability of the requested products. It is important to provide us with all the information required for the correct invoicing and dispatch of your order. A telephone number and e-mail address enable us to notify you if an item is unavailable or if there is a problem with your order.
PRICES AND PRICE REVISIONS: Prices shown may vary according to the economic conditions in force: prices of origin, exchange rates, customs duties, VAT rates, transport costs. Price revisions will not be communicated to the buyer, but will be directly included in the product sheet on the site.
CUSTOMS DUTIES: Any order placed on the Site and delivered outside the EEC may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These customs duties and taxes are your responsibility. We are not obliged to check and inform you of applicable customs duties and taxes. To find out, we advise you to contact the relevant authorities in your country. For shipments outside Europe, we can provide you with a tax-free delivery note on request.
PAYMENT: You can pay by credit card, cheque, bank transfer, Paypal, ALMA or cash. Cards issued by banks domiciled outside France must be international bank cards. Payment by cheque is only possible for cheques in euros drawn on a bank domiciled in France, the French overseas departments and territories or Monaco. In all other cases, please contact us to arrange a bank transfer. Cheques should be made payable to ELITE DIFFUSION, and sent to the address below: ELITE DIFFUSION 189 Boulevard Brémont 95320 SAINT LEU LA FORET France. All purchases are payable at the head office of our company with the order of the products. Cheques will not be cashed until the products ordered have been dispatched, unless both parties agree otherwise. For all new customers, payment will be cashed at the time of the opening order. NB : We remind you that our site allows you to make your purchases, to send us your order by validating the option payment by check in order to avoid the payment by Credit Card if you wish it. In this case, we will wait for your payment by cheque with your order number or a printed copy, and we will use your telephone number or e-mail address to contact you if necessary. In all cases, we accept a simple order on plain paper, accompanied by your contact details and payment.
SHIPPING: Shipment is always at the buyer’s expense, except in the case of exceptional special offers, according to the conditions in place on the site, when it may be partially or totally offered by Elite Diffusion. Shipments within the European Community or to other European countries are at the buyer’s expense under the conditions mentioned on the electronic order form or within the limit of partial coverage under the promotional conditions applied to French territory by Elite Diffusion. Shipments to French overseas departments and territories are at the buyer’s expense according to the conditions mentioned on the order form or within the limit of a partial coverage at the promotional conditions applied to the French territory by Elite Diffusion. For all other destinations, please contact us at 33 1 34 50 22 22 or info@elitediffusion.com. The purchaser undertakes to check the condition of the product on receipt and to make reservations with the carrier in the event of serious or proven doubt. Any claim, to be valid, must reach Elite Diffusion at the latest within three days of the date of arrival of the goods. The sooner the better.
Elite Diffusion now offers several types of shipment:
1 – Hand delivery: when hand delivery is selected, please contact us on 01 34 50 22 22 to arrange a date and time to come to our premises.
2 – Colissimo shipment, delivery against signature, with insurance: when delivery against signature is selected, Elite Diffusion takes care of a shipment with delivery against signature, and insures the parcel up to the value of the contents. This is the best option to ensure you receive your order on time and without hassle.
3 – La Poste parcel delivery service: benefit from parcel delivery to the nearest parcel delivery point to your home or workplace.
4 – UPS shipping: enjoy express shipping for orders that can’t wait
DELIVERY TIME AND PRODUCT AVAILABILITY: We keep almost all the products shown in stock and are able to dispatch your parcel the same day, if you order before 3pm. However, an item may be temporarily out of stock. It may also happen that the item is out of stock between your order and our restocking with the manufacturer. In this case, you will be offered a refund, credit note or exchange. Delivery dates are given in good faith but without obligation on our part. We will not accept any penalty or claim for compensation. However, cancellation of orders due to late delivery will be accepted after twenty working days.
RETURN: Any defective item will be exchanged free of charge if you notify us of the defect within 5 working days. Whatever the reason for the return, the buyer is responsible for the cost of careful packaging and reshipment to our premises of the product in question, Elite Diffusion assumes the cost of second delivery. Please note: all returns must be validated by ELITE DIFFUSION. An after-sales service acceptance form (RMA) will be sent to you by email, and must be completed as fully and accurately as possible. If a parcel reaches us without a valid RMA slip, it will be refused. If a parcel arrives with a COD (cash on delivery), it will be refused.
RESERVATION OF OWNERSHIP: In accordance with law no. 80.335 of May 12, 1980 and the law of January 25, 1985: The equipment and supplies sold remain the property of Elite Diffusion until full payment of the price. It must be made clear that the buyer accepts this retention of title clause in its entirety at the time of the first commercial relationship, without it being necessary to specify its content at each delivery and for the entire duration of our future contractual relations.
